Civil expert evidence is commonly governed by CPR Part 35 and its practice direction. Permission, scope, written questions and joint discussions should be considered when the instruction is drafted.
Family proceedings
Family expert evidence is controlled by the Family Procedure Rules, including Part 25. Necessity, proportionality, timescale and the specific questions for the expert are central to the court’s decision.

- ✓Identify all parties to the instruction
- ✓Use a jointly agreed letter where ordered
- ✓Tell the expert immediately about timetable changes
Criminal proceedings
Criminal instructions should identify the issues in dispute, applicable directions and disclosure obligations. Experts must keep their opinion under review as further material becomes available.
