A report must assist the court
An expert’s overriding duty is to the court. The report should identify the material considered, explain the reasoning behind each opinion, distinguish fact from assumption and acknowledge any material limitation.
Good evidence is transparent
A well-structured report explains alternative views and the basis on which they are accepted or rejected. Technical language should be defined so that judges, advocates and parties can follow the reasoning.
